ما هو عقـد الاستيراد ؟ 

عقد الاستيراد هو عقد قانوني ملزم بين طرفين أو أكثر من الممكن أن يكونوا أشخاص طبيعية أو أفراد . 
تتم صياغة  هذا العقد بين الشركات أو الافراد عندما يشتري المرء سلعا من الخارج عن طريق الاستيراد.

1 . تحديد الأطراف

2 . شرط الدفع 

–  يتحدث بند الدفع عن إدارة الإتاوات والاستحقاق والدفع والبيانات المحاسبية والفوائد والدفاتر والسجلات ومراجعة الحسابات بشكل سرى بالنسبة للحق فى الاستخدام الدائم لذلك الاصل .

3 . شـرط التوقيت 

– يتحدث هذا الشرط عن ما هي المدة المحددة لهذا العقد والى متى سوف تستمر هذة العلاقة التجارية . 

4 . شرط التجديد 

– يتحدث هذا البند عن انه هل مع الوقت البعيد سوف تكون هناك فرصة لتجديد شروط الاتفاقية أو هل ستكون هناك تكاليف مصاحبة لهذة التمديد . 

5 . تحديد المسؤولية 

– يجب ان تحدد من الذى سوف يقع عليه عاتق المسؤولية اذا ساءت الأمور على المصدر أم المستورد 

6 . شرط الانهاء 

– بند الإنهاء يحدد الشروط التي سيتم إبرام الترتيب بموجبها. يمكن أن يحدث الإلغاء حتى يتم الوفاء بالواجبات التعاقدية. ولكن لا يزال من الممكن تخصيص بنود الإنهاء ، يوضح بند الإنهاء الشروط التي يمكن للأطراف من خلالها إنهاء علاقتهم القانونيه وإنهاء التزاماتهم التعاقدية

ما هي أهمية عقود الاستيراد بين المستورد والمورد ؟ 

1. تضمن لك الحقوق من الناحية القانونية أى انك ستبقى فى أمان دائم كمستورد لانك تتعامل تحت ظل القوانين . 
2. يساعدك عقد الاستيراد فى حل الخلافات والنزاعات بين المورد والمستورد ، لذلك يمكن ان يساعد العقد على حمايتك بطرق عديدة لانه يسمح لك بالتوجه الى المحاكم من اجل ضمان حقوقك . 
3. يحمي ملكيتك للمنتج أو السلعة لانه يضع إطار قانوني يمنع المورد فيه من بيع منتجك لأية جهة أو الافصاح عنها وهو شرط السرية وعدم الافصاح . 
4. كتابة العقد يخلق يقين لدى المورد والمسترد لان الاتفاق الشفوى من الممكن ان يسبب الكثير من الاخطاء والاضرار ، لذلك كتابة العقد يحدد فيها المورد والمستورد جميع النقاط المتفق عليها لعدم حدوث اى خطا .
